Terms and Conditions

Definitions: “Customer” or “you” is the party or parties renting the equipment. “Company” and “us” refers to Mid Bay Rentals LLC.

“Rented equipment” applies to all products and services provided by the Company. Rented Equipment: The equipment is for rental purposes only. Customer shall keep and maintain this equipment in good repair and shall replace all damaged and/or broken parts immediately. Any equipment lost, not returned or returned damaged shall be charged to the customer at present selling price. Customer shall not loan, sub-let, rent or in any other manner dispose of the same to any person without written consent of the company. Reservations: Reservations made online or by phone, must be secured with a valid credit card. A telephone number must be provided at the time that a reservation is made. Online reservations will be confirmed by email or telephone within forty-eight (48) hours of the reservation.

Fees and Payments: Customer agrees to pay for services in full at time of reservation and before delivery. Services include, but are not limited to: Rental fees, state and local tax, and delivery fees. Minimum same-day or next day delivery fee is $25. Orders must be available for pick up at 9:30am on the day of pick up. If property is vacated before pick up occurs, please leave the equipment in an accessible spot. If the rental equipment is unable to be picked up by Lessor, Lessee will incur a missed pick up fee as well as additional rental charges, so please do not leave the equipment locked away.

Cancellations and Early Terminations: Travel plans may change. There is a flat $20 processing fee on all orders canceled outside of 3 calendar days prior to delivery date. Orders canceled within 3 days of the delivery date will be charged 50% of the original amount. There are no refunds on early returns. We have a no refund policy during the periods between November 25th – January 3rd and May 1st – September 1st. Please call us if your plans change to prevent these additional charges and so that we may better accommodate your needs.

Delivery: If we arrive to the property for delivery at the requested time and get no answer at the door, cannot make contact, and have no prior special delivery instructions, there will be a $25 reschedule fee for the delivery of the equipment. We cannot guarantee same day rescheduling. There will be no refunds on equipment if we are not able to reschedule delivery until next day. We do not leave equipment outside unless it has been discussed and confirmed prior to delivery.

Sanitation: All equipment is cleaned and sanitized prior to delivery. Food residue found on returned items (other than high chairs) may be charged additional cleaning fees. The minimum cleaning fee is $25 for items returned with excessive soiling. Excessive soiling substances may include, but are not limited to: gum, bodily secretions, crayons, ink, stickers, food (except on high chairs), SUNSCREEN, and other difficult to remove stuff TBD.

Safety: Safety is our primary concern. Equipment rented by Mid Bay Rentals LLC is up to date and meets current federal standards where applicable. Equipment is continually checked and replaced as needed. If you suspect your equipment is faulty or requires repair please contact us.

Release of Liability and Indemnity: Any personal injuries or property damage suffered by any person using this equipment shall be assumed by the lessee and no liability whatsoever shall attach to the lessor. Lessee agrees to indemnify and save harmless the lessor against all loss, damage, expense and penalty arising from any action on account of any inquiry to person or property occasioned by the operation, handling or transportation of the leased property during the rental period or while the property is in the possession or control of the lessee.

Hold Harmless: You assume all risks inherent in the operation and use of the Rented Equipment by You and anyone else. You agree to assume the entire responsibility for the defense of, and pay, indemnify, and hold US harmless from, and release US from, any and all claims for damage to property or bodily injury (including death and/or virus), or for loss of time and inconvenience resulting from the use, operation or possession of Rented Equipment, whether or not it be claimed or found that such damage or injury resulted in whole or in part from Our negligence, from the defective condition of the Rented Equipment or from any cause.

Declaration: The customer agrees that you have read and understand these terms and conditions. The customer shall agree that an electronic signature is acceptance of these terms and conditions.
